Heard the learned counsel for the applicant and the learned A.G.A.
This application has been filed with a prayer to quash the order dated
12.10.2009 passed by the learned C.J.M. Agra in case no. 208 of 2009
under sections 504,506 I.P.C. whereby the N.B.W. has been issued.
From the perusal of the it appears that due to non appearance of the
applicant N.B.W. has been issued. There is no illegality in issuing the
N.B.W., therefore, the prayer for quashing the same is refused.
However, considering the nature of the case, it is directed that the
applicant shall appears before the court concerned within 20 days from
today, till then the N.B.W. issued against the applicant shall be kept in
abeyance.
In case the applicant applies for bail, the same shall be heard and
disposed of on the same day by the courts below.
With the above direction, this application is finally disposed of.
