The landowner is in appeal before this court against the award
of the learned Additional District Judge, Karnal, passed on 4.6.1990.
Briefly, the facts are that vide Notification dated 5.7.1982,
under Section 4 of the Land Acquisition Act, 1894, the State of Haryana
acquired land situated in Karnal for a public purpose namely for the
development and utilisation of the land as residential and commercial area
in Sector-7 of Urban Estate, Karnal. The Collector assessed the market
value of the land at Rs. 900/- per biswa. The learned Additional District
Judge vide judgment dated 4.9.1990, determined the compensation at the
rate of Rs. 41/- per sq. yard.
Learned State counsel very fairly submitted that the claim made
by the appellant in the present appeal is squarely covered by the judgment
of this Court in R. F. A. No. 882 of 1983- Dr. Rajwant Singh (Died)
through LRs. Vs State of Haryana, where the compensation for acquisition
of land vide notification dated 5.7.1982 was assessed at Rs. 51.07 paise per
square yard.
For the reasons recorded in Dr. Rajwant Singh’s case (supra),
the present appeal is allowed in the same terms.
