Heard learned counsel for the petitioner and Sri D. D. Chauhan, learned
counsel appearing for respondent no.3.
After arguing on several issues learned counsel for the petitioner has confined
his submission to a direction being issued to Deputy Director of Consolidation
to decide the pending revision expeditiously within a fixed time frame.
Considering the facts and circumstances of this case, this petition is disposed
of with the direction to the Deputy Director of Consolidation, Moradabad /
respondent no.1 to decide pending revision expeditiously within a period of
four months from the date of production of certified copy of this order.
Learned counsel for the petitioner has also submitted that there is stay
application on which no orders have been passed by the Deputy Director of
Consolidation. Further direction is issued to respondent no.1 to dispose of the
stay application within three weeks from the date of production of certified
copy of this order after hearing the parties concerned.
Sri D. D. Chauhan, learned counsel for the respondent-Gaon Sabha, states that
as on date there is no proposal to make allotment.
In the circumstances, it is provided that till the disposal of the stay application
allotment, if any, is made, allottees shall not be put into possession.
This interim order has been passed in view of the averments contained in the
petition. However, it would be open to the Deputy Director of Consolidation
to dispose of the stay application on his own merits without being influenced
by the interim relief granted in this order.
