ORDER

S.J. Mukhopadhaya, J.

1. The grievance of the petitioner is that though he retired from the services of the Bihar State Electricity Board on 31st June, 2000 has not been paid the arrears of pension in the revised scale of pay.

2. It is stated that the petitioner retried from the services of the Board as Vehicle Driver on 30th June. 2000 from the office of the Electric Supply Area, Kusai Colony, Ranchi.

3. The grievance of the petitioner is that though the respondents have released pension, but in the old scale and not in the revised scale. Similarly, leave encashment and gratuity have been sanctioned in the old scale and the total benefits including the arrears on revision of pension had not yet been paid to the petitioner.

4. Having regard to the facts and circumstances, as the matter is to be looked into by the General Manager-cum-Chief Engineer, Electric Supply Area, Ranchi, the case is remitted to the respondents with taking into consideration the revised scale of pay and pay the admitted dues, including the arrears within two months from the date of receipt/ production of a copy of this order. On failure, the respondents will be liable to pay 8% interest on such admitted retrial benefits to be calculated from the date of retirement.

5. If the respondents dispute any claim or part thereof, they will forward the ground to the petitioner within the aforesaid period of two months.

6. The writ petition stands disposed of
with the aforesaid observations and directions.

7. Writ disposed of with directions.
