No counter affidavit has been filed on behalf of the State though
time was granted twice for filing the counter affidavit.
Learned counsel appearing for the petitioner submits that
the petitioner got retired from the post of Deputy Superintendent of
Education, Ranchi on 29.2.1996 but certain pre and post retiral dues
towards leave salary, group insurance, part of G.P.F. and the arrears of
salary accrued on account of first time bound promotion, being granted
w.e.f. 1.4.1981, have not been paid though the petitioner in this respect had
made several representation before the respondent no. 3-District
Superintendent of Education, Ranchi but he did not care at all to look into
the matter and to pass order in this respect.
Since the claim is still to be determined by the Authority,
this writ application is disposed of with a direction to the petitioner to file a
fresh representation, putting forth all the claims, which have been raised in
this writ petition, before the District Superintendent of Education, Ranchi
(respondent no. 3) along with a copy of this order within three weeks from
today. On receipt of such representation, respondent no. 3 shall be taking
decision over the claims of the petitioner within a period of six weeks
thereafter.
