The petitioner is an accused in the case registered for the offence under
section 392 of the Indian Penal Code.
Learned counsel for the petitioner submitted that the petitioner has been
falsely implicated in the case; nothing incriminating has been recovered from his
possession; petitioner has got no criminal antecedent; he is in custody since
July,2010; petitioner is a local permanent resident; there is no chance of his
absconding.
Learned APP opposed the prayer for bail of the petitioner and submitted
that on the petitioner’s confession, looted articles were recovered; petitioner had
also been identified in the T.I.Parade. However, he has not disputed the other
contentions of learned counsel for the petitioner.
Regard being had to the facts and circumstances of the case, the above
named petitioner is directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand) with two sureties of the like amount each to the
satisfaction of learned Chief Judicial Magistrate, Chatra in connection with
Simaria P.S. case no.09 of 2010, corresponding to G.R. case no.52 of 2010.
