An affidavit has been filed by the S.O.C. Sri Raj Kumar stating
therein that he has fully complied with the order and direction of
this Court dated 25.5.2010. Annexure-1 to the affidavit is a report
relating to so called change of possession. Perusal of the said
report, it transpires that it has very clearly been mentioned that the
contesting respondent Ram Khelawan has refused to endorse his
signature and, therefore, in my view it is not a complete
compliance of the order of this Court. The S.O.C. Sri Raj Kumar is
present in the Court.
The Court has also been informed by Sri S.C. Tripathi, counsel for
the petitioner that the contesting respondent Ram Khelawan
instead of complying with the Court’s direction, filed an
application before the A.D.M./D.D.C. Sri Hub Lal, who passed an
interim order on 22.6.2010. When the S.O.C. was questioned about
it, he has unequivocally admitted this fact but he has further stated
that the A.D.M. was apprised of the order of the High Court then
said order was recalled by the A.D.M. Sri Hub Lal on the very
next day.
In view of blatent abuse of the order of this Court, contesting
respondent Ram Khelawan as well as A.D.M. Sri Hub Lal shall be
present along with S.O.C. Sri Raj Kumar, on the next date fixed.
List this writ petition on 15.7.2010.
The Chief Judicial Magistrate, Jaunpur shall ensure presence of
Ram Khelawan in the Court on 15.7.2010.
Learned Standing Counsel shall inform the Chief Judicial
Magistrate, Jaunpur to take appropriate steps for presence of Ram
Khelawan in the Court on 15.7.2010.
Let a certified copy of this order be given to the learned Standing
Counsel free of cost.
