Heard learned counsel for the applicant, learned A.G.A and perused the
record.
Learned counsel for the applicant submitted that the applicant was
falsely implicated on the allegation of embezzlement of Rs. 60,659/-.
As per prosecution case the applicant was LIC agent and regarding the
premium/installment deposited by the persons/ beneficiaries the forged
receipts were being issued by the applicant. The applicant is in jail since
1.8.2008. First bail application was rejected by Hon’ble Shiv Charan, J.
on 12.12.2008. Hence the second bail application was filed on
12.10.2008. In compliance of the order. The applicant has already
deposited Rs. 30,000/- before the Court of Chief Judicial Magistrate,
Fatehpur. The rest of the amount will be deposited within 30 days after
release on bail.
In view of the aforesaid fact he also contended that there is delay in
trial and the matter is of the year 2008. In view of the fact, the applicant
is entitled to be released on bail.
In view of the aforesaid fact without expressing any opinion
on merit, let the applicant Ram Sajivan be released on bail, in
case crime no. 200 of 2008, under Sections 419, 420, 467,
468, 471 and 406 IPC, P.S. Husenganj, District-Fatehpur on
his furnishing a personal bond and two sureties each in the
like amount to the satisfaction of the court concerned.
Provided the remaining amount is deposited within 30 days after release
on bail before the Chief Judidical Magistrate concerned. Failing which
the bail application was automatically stand cancelled, and applicant
may be taken into custody.
With the aforesaid observation the present bail application is allowed.
