On the death of petitioner Mr.Ram Smujh Singh his legal heirs being
wife and son moved an application for substitution in his place on 8th of
December, 2004. During the pendency of the said application the
widow of the petitioner (deceased), namely, Smt. Vindhyavasini Singh
also died on 3.9.2009. Now his son, namely, Mr.Jamuna Prasad Singh
being his legal heir remains in place of the petitioner, therefore, the
application is allowed to substitute Mr.Jamuna Prasad Singh son of
Ram Samujh Singh as legal heir in place of petitioner.
Let necessary amendments be incorporated within three days.

On the death of Algu Singh, opposite party No.2, the petitioner moved
an application dated 6th of September, 1994 to substitute his sons in his
place as opposite parties. I am informed that during the pendency of the
said application Mr.Ram Ji Singh the proposed legal heir also died and
to substitute his legal heir in his place another application has been
moved by the petitioner, but this application is pending for order, so far
as the other proposed legal heirs, therefore, the application is allowed to
substitute the remaining legal heirs.
Let them be substituted as opposite parties by necessary incorporation
in the array of the parties within three days.

On the death of proposed legal heir Mr.Ram Ji Singh of opposite party
No.2, the petitioner moved an application for substitution to substitute
his legal heirs, the description of whom have been given in the
application. The application has been delayed therefore the same has
been filed with application for condonation of delay and for setting
aside abatement, but till date no objection has been filed, therefore, the
delay in filing the application is condoned and the abatement is set aside
and a direction is issued to substitute the legal heirs of Ram Ji Singh in
his place.
Let necessary amendments be incorporated within three days.
