This is an application for disposing of the appeal being

covered by decision of this Court in R.F.A. No. 1281 of 1999 titled as

Gurdev Singh vs. State of Haryana decided on 27.10.2006.

Learned counsel for the respondent – State does not dispute

and confirms that the present R.F.A. is covered by the aforesaid R.F.A. No.

1281 of 1999 decided on 27.10.2006.

In view of the statement made by learned counsel for the

parties, the present appeal is disposed off in the same terms as RFA No.

1281 of 1999 decided on 27.10.2006 and the various awards under

challenge rendered by the reference Court are set aside. The matter is

remanded back to the Reference Court for fresh decision of the reference

petitions in accordance with law and in accordance with the observations

made by the Court in the said R.F.A. No. 1281 of 1999.

The parties through their learned counsel are directed to

appear before District Judge, Panchkula on 7.12.2009.

Disposed off in the same terms as R.F.A. No. 1281 of 1999.
