It appears that a couple of orders were
passed on 21.5.2010 and before that on 30.4.2010
requiring that the wife Smt.Poonam Gupta was
required to appear before this Court for
receiving the draft of Rs.8,00,000/- which is
the amount towards a settlement of permanent
alimony on account of a direction of the High
Court of Allahabad in a matrimonial proceeding
which was disposed of by that court. It is not
known to this court as to whether the Chief
Judicial Magistrate, Sasaram has acted as per
the directions of this Court and had ensured the
service of the notices as per the Court’s
direction contained in the above noted two
orders passed in the present petition upon Smt.
Poonam Gupta. It is informed by the learned
counsel for the petitioner that in compliance to
the order of this Court properly addressed
notices were places in custody of the Chief

Judicial Magistrate, Sasaram in the light of
this Court’s order.
Sri Tejbahadur appearing on behalf of
the Opposite Party no.2 submits that he has
contacted the informant as also Opposite Party
no.3 Smt. Poonam Gupta by telephone also,
besides sending letters under Speed Post but
there is no response from either of them. This
Court is making its last effort to put into the
knowledge of the lady Smt. Poonam Gupta,
Daughter of Sri Jay Narayan Gupta, Resident of
Mohalla-Karan Sarai, P.S. Sasaram, District-
Rohtas the requirement of her appearing before
this Court, by directing the Chief Judicial
Magistrate, Sasaram to issue summons through
the officer-in-charge, Town Police Station,
Sasaram to produce the lady before him so that
she may be informed that she is required to
appear before this Court on 24.8.2010. The Chief
Judicial Magistrate, Sasaram shall make a report
to this Court by enclosing the copy of the order
which he might be drawing after production of
the lady before him as an evidence of putting
the above information in the knowledge of the
lady that she is required to appear on the above

date before this Court when this petition shall
be listed again so as to receiving the draft
towards the payment of her alimony as per the
direction of High Court of Allahabad.
The copy of the order shall be
transmitted to the Chief Judicial Magistrate,
Sasaram(Rohtas) at the cost of the petitioners.
