2 21.04.2011 Heard learned counsels for the petitioners

and the State.

The petitioners are apprehending their arrest

in a case registered under Sections 147, 148, 447, 341,

323, 504 and 302 of the Indian Penal Code.

The accusation against six accused persons is

of making assault by lathi to the informant and his

wife. Subsequently, the wife of the informant died.

It is submitted by learned counsel for the

petitioners that there is general accusation against all

the accused persons and the informant has received

simple injury. Moreover, in para 17 of the case diary, a

statement of the deceased was recorded by the

concerned I.O. that she sustained injury accidentally.

Considering the omnibus general allegation

against six persons other accused persons have been

granted anticipatory bail by this

Court, let the above named petitioners, be released on

anticipatory bail, in the event of their arrest or

surrender before the learned Court below within a

period of 12 weeks from today, on furnishing bail bond

of Rs. 10,000/- (ten thousand) each with two sureties of

the like amount each to the satisfaction of the learned

Chief Judicial Magistrate, Vaishali in connection with

Jandaha P.S. Case No. 54/2010, subject to the

conditions as laid down under Section 438(2) Cr.P.C.
