16 23.09.2010 Mr. Baidya Nath Thakur, learned counsel for the

petitioner, appears and informs that Partition Suit No. 24

of 2002 having already been disposed of, this Civil

Revision filed against the order of the appellate court in

the matter arising out of Order 39 Rules 1 and 2 of the

Code of Civil Procedure has become infructuous.

In the above view of the matter, this civil revision

is dismissed as having become infructuous.
