The respondents will file their counter affidavit

indicating their stand though prima facie the reasons are already

indicated in the impugned order contained in annexure-1 as to why

the petitioner cannot be appointed.

Learned counsel for the State further informs the

Court that a criminal case has been filed against the petitioner

which is pending trial before the competent court and that is yet

another circumstance why no adjudication is required to be made

at this stage.
