40. 21.09.2010 After some arguments on I.A. No. 6447 of 2009,

the learned counsels appearing on behalf of the appellants as

well as on behalf of the respondents jointly prayed that the

appeal itself may be heard at an early date and the

application may be considered at the time of final hearing.

In view of this submission and since the appeal

itself is of the year 1977, I direct the office to list this first

appeal under the heading ‘For hearing’ after ten days without

the paper book if it is otherwise ready for hearing. This

interlocutory application shall be considered at the time of

final hearing of the appeal itself.
