Hon'ble Shabihul Hasnain,J.

A request has been made by learned Additional Chief Standing counsel Mr.
V.S.Tripathi that the officer namely the District Magistrate, Sultanpur was
summoned by this Court. He is present. Since the officer has to attend the
duties of the District, this case may be taken up out of turn.

The Court realizing that the prayer of the learned Additional Chief Standing
counsel is quite genuine, allows the same.

Case has been called. Sri H.S.Tiwari is present and the District Magistrate,
Sultanpur is also present. He was called because of some communication gap
between him and the earlier officer and correct facts could not be brought to
the knowledge of the Court. Accordingly, District Magistrate was summoned
to explain the position. It has been stated by Sri V.S.Tripathi that the orders
have been complied with and the petitioner has been selected after giving
benefit of 10 per cent weightage of handicapped quota. The District
Magistrate has stated that there was no intention to give any wrong
information to the Court.

His plea is accepted as quite genuine.

Since the orders have been complied with nothing needs to be decided by this
Court any more.

Writ petition is allowed accordingly.
