08/ 07.09.2011 In compliance of my order dated 9.8.2011,
the Commissioner, Tirhut Division and the Collector,
Muzaffarpur are present.
It is submitted by them that in compliance
of the orders of the High Court, roster with regard to
Class IV vacancies in the Collectorate and the
attached offices has been cleared pursuant whereto 22
persons including petitioner no.1 have been issued
appointment letter. Appointment in regard to the
other Line Department could not proceed as the
District Animal Husbandry Officer, Phylaria Officer,
Phylaria Control Unit, Executive Engineer, N.H.
Division No. II, Superintending Engineer, Minor
Irrigation Circle, Executive Engineer, N.H. Division,
Executive Engineer, Irrigation (Mechanical)
Division, Civil Assistant Surgeon-cum- Chief
Medical Officer, Factory Inspector, Assistant
Director, Labour and Employment Department,

Deputy Director, Panchayati Raj, District Sub-
Registrar, District Agriculture Officer, Executive
Engineer, PHED, District Malaria Officer, Divisional
Forest Officer, Superintending Engineer, Rural
Works Department, Circle No. II, Executive
Engineer, Drainage Division, Executive Engineer,
Building Division, Joint Director, Agriculture,
Principal, Superintendent, SKMCH, Principal,
Industrial Training Institute, Additional Chief
Medical Officer, Superintending Engineer, North
Bihar, Road Circle and District Statistical Officer, all
situate within the district of Muzaffarpur have not
responded to the request of the Collector,
Muzaffarpur to submit their Class IV vacancies for
roster clearance before the Commissioner, Tirhut
Division and on account of their non-cooperation, full
compliance of the orders of the High Court dated
1.9.2009, Annexure-4 read with order dated
20.5.2011 passed in the instant case to make
appointment on Class IV post in the Collectorate and
the attached office is not being made.
Issue notice of contempt to the aforesaid

officers to submit the vacancies available in their
offices for roster clearance before the Commissioner,
Tirhut Division by 21.9.2011, failing which they
should appear before this Court on 28.9.2011.
The notice to the aforesaid officers should
be served by making available the web copy of this
order to them by the Collector, Muzaffarpur.
Put up on 28.9.2011 maintaining its
position under the same heading when Collector,
Muzaffarpur shall appear before this Court.
