Mr. D.K. Gaur, for the petitioner.

Heard learned counsel for the petitioner.

It is contended by learned counsel for the

petitioner that the District Collector cancelled the

arm license of petitioner on the ground that there are

criminal cases registered against the petitioner’s

son. As per learned counsel for the petitioner, no

such ground can be taken into consideration for the

purpose of deciding the question of grant or

cancellation of arm license issued by the competent

authority.

In this view of the matter, the order dated

10.7.2007 passed by the Divisional Commissioner,

Bikaner is hereby set aside and the case is remitted

to the Divisional Commissioner, Bikaner for deciding

the matter afresh while ignoring the fact of

registering the case against the son of petitioner.

Further, the Divisional Commissioner is directed to

decide the appeal independently on merit alone in

accordance with law within a period of two month.

The writ petition is disposed of in above

terms.
