ORDER

1. Learned
advocate Mr. Majmudar for the petitioners states that despite the
statement being made before this Court by a counsel appearing for the
respondent (Surat Municipal Corporation), to the effect that, the
Corporation will take action in accordance with law. In that view of
the matter, the petition stands disposed of with direction that the
Corporation will take appropriate action in accordance with law….

2. The
authorities are deviating from final development plan, which is as
set out in the sketch, at page No.104. The learned advocate states
that on 19.11.2010, the authorities have conducted themselves in a
manner which shows that they are deviating from the final development
plan which was sanctioned on 2.9.2004.

3. The
learned advocate for the petitioners is granted time to put on record
the photographs showing the construction activity along with a
sketch.

The
matter is adjourned to 25th November 2010.
