: The petitioner is an accused in the case registered under
Sections 304B/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submitted
that the petitioner has been falsely implicated in this case; the cause of
death could not be ascertained; there was no demand of dowry or any
clear allegation of cruelty before her death; the allegation does not
attract an offence under Section 304(B) I.P.C.; petitioner is in custody
since August, 2009; there is no likelihood of conclusion of the trial in near
future.
Learned A.P.P. opposed the petitioner’s prayer for bail and
submitted that the petitioner is the husband and he is a named accused;
other materials have also been collected against him; the trial is likely to
be concluded shortly.
Regard being had to the nature of allegation and stage of the
case, I am not inclined to release the petitioner on bail.
Petitioner’s prayer for bail is rejected. However, if the petitioner’s
trial is not concluded till 30th September, 2011, the petitioner shall be at
liberty to renew his prayer for bail in the court below.
