 ORAL
ORDER

After
the matter is heard for some time, taking into consideration the
submissions made by learned advocate Mr.J.T.Trivedi for the
petitioner and learned Senior Advocate Mr.Kamal Trivedi with learned
advocate Mr.Chhatrapati for the respondent it is deemed fit that the
petition be disposed of by passing the following order.

The
respondent is directed to deposit the amount, which is shown in the
confirmation letter, with 9% interest from the date of confirmation
letter till the date of deposit with the Registry of this Court on
or before 15th November, 2010. The Registry is directed
to invest this amount in a fixed deposit initially for a period of
three years in cumulative fixed deposit. This amount will be subject
to final outcome of the civil proceedings
which may be filed by the petitioner to establish its claim.

It
is clarified at the request made by learned Senior Advocate for the
respondent that this order is passed without prejudice to all the
rights and contentions of both the parties. It will be open for the
respondent to put up their case/counter-claim before the competent
civil court in accordance with law, as may be deemed fit.

With
the aforesaid directions, the company petition is disposed of.
