2. 02.08.2010. Heard learned counsel for the

petitioner and counsel appearing for the State.

The petitioner being the husband is

apprehending his arrest in a complaint case in

which cognizance has been taken under Section

498A of the I.P.C.

It is submitted by the learned counsel

for the petitioner that the petitioner is ready

to keep the complainant as wife with full

dignity and honour. The impugned order suggests

that the complainant refused to go to her in-

laws house due to apprehension to her life.

In that view of the matter, let the

petitioner, Ranjit Sharma, be released on bail

in the event of his arrest or surrender before

the learned court below within a period of

twelve weeks from today in connection with

complaint case no. 2807 of 2006 on furnishing

bail bond of Rs. 10,000/-(Ten Thousand) with

two sureties of the like amount each to the

satisfaction of the learned S.D.J.M., Purnea,

subject to the conditions as laid down under

Section 438(2) of Cr. P.C.

It is made clear that as and when the

complainant will file an application before the

learned S.D.J.M., Purnea, expressing her

willingness to resume the conjugal life then

the learned court below will issue notice to

the petitioner when the petitioner will appear

and take the complainant to her matrimonial

home and keep the complainant as wife with full

dignity and honour. If the petitioner fails to

perform his duty as husband then the

complainant will be at liberty to file an

application for cancellation of bail of the

petitioner.
