Heard learned counsel for the applicant, the learned Additional
Government Advocate and perused the F.I.R. and other relevant
papers filed in support of the bail application.
Submission of learned counsel for the applicant is that the
applicant is driver of the tanker which was loaded with kerosene
oil. Learned counsel further submits that he had nothing to do with
the alleged crime and the owner of tanker was one Pankaj Kumar
Singh. Learned counsel further submits that the applicant stated
that he had instructions from Neeraj Singh and Raju Singh to load
1400 litres of kerosene oil. He had no knowledge with regard to
kerosene oil and the drum in which it was filled, as to whom it
belonged. Learned counsel contends that the applicant is
innocent and, as alleged, he had no knowledge that the loaded
kerosene oil was for black marketing. It is also submitted that
there is no evidence that the recovered kerosene oil was to be
black marketed. The applicant is in jail since 28.6.2010, as
averred in para 2 of the application and has no previous criminal
history, as averred in para 17 of the application.
Considering the facts and circumstance of the case, let the
applicant be released on bail in Case Crime No. 417/2010 under
section 3/7 Essential Commodities Act, P.S.Kotwali Dehat, District
Hardoi on his filing a personal bond and two sureties each in the
like amount to the satisfaction of the court concerned/remand
Magistrate.
