Heard
Mr. Mehul Rathod, learned advocate for the applicant and Mr. Devang
Vyas, learned APP for the opponent State at length and in great
detail.
Having
considered the rival submissions and on perusal of the FIR, police
papers, I am of the view that it would be just and proper in the
facts and circumstances of the case that if direction is given to the
Judicial Magistrate First Class, Kadi, to dispose of the matter
finally within three months from the date of receipt of this order,
then, it would meet the ends of justice.
In view
of the above, learned advocate for the applicant seeks permission to
withdraw the application. Permission, as prayed for, is granted. The
application stands disposed of as withdrawn. Rule is discharged.
However,
it would be open for the applicant to move appropriate application
for bail if the case is not disposed of within stipulated period of
three months.
