02 04.04.2011 Heard learned counsels for the petitioner and
the State.
The petitioner being the headmaster of the
school is apprehending his arrest in a case registered
under Sections 409 and 420 of the Indian Penal Code.
It is alleged against the petitioner that he
spent Rs. 66,302.90/- in the mid-day-meal from
February, 2005 to January, 2007, but failed to submit
the vouchers, which was demanded in the year 2010.
It is submitted by learned counsel for the
petitioner that the petitioner retired on 31.01.2008 and
he has handed over the entire documents with the
balance amount to his successor. Hence, he was not in
a position to give the vouchers for the alleged period.
Considering the fact that the petitioner has
retired in the year 2008 when the vouchers were
demanded for the period of 2005-07 in the year 2010,
let the above named petitioner, be released on
anticipatory bail, in the event of his arrest or surrender

before the learned Court below within a period of 12
weeks from today, on furnishing bail bond of Rs.
10,000/- (ten thousand) with two sureties of the like
amount each to the satisfaction of the learned Sub-
divisional Judicial Magistrate, Bikramganj in
connection with Karakat P.S. Case No. 157/2010,
subject to the conditions as laid down under Section
438(2) Cr.P.C.
