The petitioner is accused for the offence under Section 376 of
the Indian Penal Code and there is direct allegation made by the
prosecutrix against the petitioner that finding her alone in her
house, he visited her house and committed forcible rape on her.
After having committed rape on her, he took backtrack and refused
to marry her.
Learned counsel for the petitioner submits that the petitioner
is now agree to marry the prosecutrix.
Learned counsel for the State opposes the prayer for bail.
Regard being had to the facts and circumstances of the case
and the nature of allegation, I am not inclined to grant bail to the
petitioner at this stage. Accordingly, his prayer for bail is rejected.
Learned trial court is directed to expedite and conclude the trial
within a period of eight months. If the trial is not concluded within
the stipulated time, the petitioner may renew his prayer for bail.
