	Writ Petition filed under Article 226 of the Constitution of India praying for a writ of Certiorarified Mandamus to call for the records relating to the order No. 14/2010-Cus. dated 6.12.2010 (C.No.VIII/10/46/2010-SC) passed by the 1st respondent and quash the same as illegal  arbitrary and unsustainable and further direct the 1st respondent to allow the application of the petitioner filed under Sec.127 B of the Customs Act  bearing S.A.(C) 46/2010 to be proceeded with on merits.

O R D E R

The learned counsel appearing for the petitioner had submitted that the writ petition may be dismissed as withdrawn, with liberty to move the settlement committee for the settlement of the case. He had also made an endorsement to that effect.

2. In view of the endorsement made by the learned counsel appearing for the petitioner, the writ petition stands dismissed as withdrawn, with liberty to move the settlement committee, as prayed for by the petitioner. No costs. Connected M.P.Nos.1 and 2 of 2010 are closed.
