                            J U D G M E N T

The petitioners in these writ petitions claim community status as

Christian Parava (scheduled caste converts to Christianity) for the

purpose of inclusion in select list prepared and to be prepared by

the Public Service Commission . The petitioners rely on evidence

such as their SSLC certificate in which they are shown as Christian

Parava. According to the petitioners, therefore, the petitioners are

entitled to be considered as Schedule Caste converted Christian who

are considered as ‘Other Christians’ for the purpose of inclusion in

rank lists prepared and to be prepared by the Public Service

Commission. However, the question as to whether in the Kollam area,

there are persons entitled to be considered as Christian Parava, was

considered by a Division Bench of this Court in Rajan v. State of

Kerala, 2007(1) KLT 730, wherein such claims were negatived by the

Division Bench. The Division Bench has held that they are entitled to

benefits only as Latin Catholics. That being so, the petitioners can

only claim the benefit as Latin Catholics.

In the above circumstances, these writ petitions are disposed of

with a direction to the Public Service Commission to treat the

petitioners as belonging to Latin Catholic community and consider

their claims for inclusion in the rank lists prepared or to be pared by

the Public Service Commission, provided they comply with all other

formalities prescribed for the same. In respect of rank list in

W.P.C. Nos. 21283/08 etc. -: 2 :-

operation, such consideration shall be without affecting any of the

candidates already advised.
