1. Heard
Mr.Pathak learned counsel for the applicants and Mr. Bipin Mehta,
learned counsel for opponent nos.1 and 3 and Mr.Mukesh Patel, learned
counsel for opponent no.2. Rule. Mr.Bipin Mehta, learned
counsel, waives service of notice of Rule on behalf of opponent nos.1
and 3 and Mr.Mukesh Patel, learned counsel, wavies service of notice
of Rule on behalf of opponent no.2.
2. Having
regard to the averments made in the application and submissions of
the learned counsel, sufficient cause to recall the order dated
03.03.2011 is made out. Hence the relief as prayed for in paras-5(a)
& 5(b) is granted and order dated 03.03.2011 is recalled. The
office is directed to restore the proceedings of SCA No.3600 of 2001
to its original file. The MCA stands disposed of. Rule is made
absolute in terms of the above.
