This
matter was part heard and today, it was fixed for further hearing
since Mr.NS Shevade on that day was not available. Today, his
colleague Mr.Shevade is also not present. However, Mr.A.K. Chauhan,
Officer of Railway Administration, Chief Law Assistant, is present
and he states that as the advocate is out of country and is to come
back on 7th October, 2011, time may be granted and the
matter may be kept thereafter.

Once
the matter is part heard, it is for the advocate to remain present on
the next date and if he is unable to remain present, he is supposed
to make alternative arrangement. In the present case, it is not a
matter of any private litigant, but is of railway administration,
Union of India. They have their panel advocate.

Under
these circumstances, it is directed that appropriate arrangement
shall be made. The matter is kept on 17.08.2011 for further hearing.
It is made clear to the officer concerned that if none remains
present on behalf of the Railway, Court will be constrained to
proceed ex parte.
