J U D G M E N T
MFA No.104/10 is filed by additional respondents 8 to
21 and 23 to 37 and the other appeal is filed by respondents
1 to 5 and 7 against the common order passed by the
Additional District Judge-I, Thiruvananthapuram in
I.A.Nos.2220/09, 640/10, 1453/10, 1833/09, 1832/09 and
O.P.477/05. After perusing the order and hearing the
learned counsel appearing for all the sides I feel an order has
to be passed directing the aggrieved appellants to move the
Court which passed the order to review that order or any
other relief contemplated under Order 23 of the Code of Civil
Procedure to redress their grievances. I say so because the
whole order is passed on the basis of some concessions said

to be made and compromise petition. It is also stated that
some of the parties who are before me are not parties to the
compromise petition as well. When an order is passed on the
basis of a concession or compromise and if this compromise
is not in proper form as contemplated under Order 23 of
Code of Civil Procedure the appropriate remedy for the
parties is to approach the Court which has passed the order
for review of that order bringing into the limelight their
grievances and the legal provisions. This Court sitting as an
appellate judge cannot find out the correctness of any
concessions said to be made unless it has been recorded in
writing. Therefore I pass an order with a direction to the
appellants in both the appeals to approach the court below
for review of the order which is under challenge as
contemplated by law and till the review application is
disposed of, implementation of the order passed by the
learned Judge shall be kept in abeyance. Since the matter

relates to administration there is urgency and the court
below shall try to dispose of the matter within one month
from the date of receipt of the applications and the
applications are to be filed within 10 days from today.
The appeals are disposed of accordingly.
