                          J U D G M E N T

According to the petitioner, he was advised by the Public

Service Commission for appointment as a Driver in the Kerala State

Road Transport Corporation. He says that he was thereupon

appointed as a Reserve Driver on daily wages, and this position

continued till his absorption in the regular service with effect from

21/03/1990. He continued as such, and retired from service with a

qualifying service of 9 years and 3 months, as a result of which he is

not getting pension. His contention is that he is entitled to the

benefit similar to what was granted by this Court in Ext.P6 judgment

in WPC(C) No.2776/2004 and that his entire service is liable to be

reckoned for quantifying his qualifying service for pension. It is

seen that the petitioner has raised this claim before the 1st

respondent by filing Ext.P7 and orders have not been passed

thereon.

2. Having regard to the fact that the 1st respondent is yet to

take a decision in the matter, it is directed that the 1st respondent

shall consider Ext.P7 and pass orders thereon. This shall be done

as expeditiously as possible, at any rate, within four weeks of

production of a copy of this judgment. Orders shall be passed duly

adverting to Ext.P6 judgment also.

The petitioner shall produce a copy of this judgment, along

with a copy of this writ petition before the 1st respondent for

compliance.

This writ petition is disposed of as above.
