                               JUDGMENT

A.K.Basheer, J.

Learned Standing Counsel for Hindu Religious and

Charitable Endowments (Administration) Department, Kozhikode,

after getting instructions, submits that the delay in complying with the

direction issued by this Court occurred inadvertently and particularly

since the office premises had to be shifted to another building. It is

also pointed out that, in fact, a hearing was scheduled to be held on

April 1, 2009 which was adjourned at the request of the petitioner

himself to April 18, 2009. But immediately thereafter the shifting of

the premises took place.

2. Learned Standing Counsel assures the Court that the

respondent will pass orders in the matter without any further delay,

since hearing is scheduled to be held on November 25, 2009. If the

petitioner co-operates, orders will be passed in compliance of the

Cont. case (C) No.1318 of 2009.

direction issued by this Court on or before November 30, 2009.

3. The above submission is recorded and the contempt

case is closed. However, it is made clear that it will be open to the

petitioner to revive the contempt case if the situation so warrants.
