Heard
learned advocate Mr. Dipak R. Dave appearing on behalf of petitioners
and learned advocate Mr. Yogen N. Pandya appearing on behalf of
respondent on caveat.

I
have considered submissions made by both learned advocates. I have
also examined the question raised by both learned advocates which
requires detailed examined by this Court, hence, RULE.

Ad-interim
relief in terms of Para 6(B) is granted on condition with a direction
to petitioner to pay an amount of gratuity which is found to be due
in favour of respondent, Rs.3,00,486/- by account payee cheque in the
name of respondent Bharat Vadilal Shah, within a period of four
weeks from today, after proper verification.

The
above condition incorporated by this Court in respect to the payment
of gratuity which is to be made by petitioner to respondent employee,
is without prejudice to the rights and contentions of both parties.

Notice
as to interim relief returnable on 18 th
June 2010.

Learned
advocate Mr. Pandya waives service of notice of rule on behalf of
respondent.
