                          J U D G M E N T

The petitioner herein is the registered owner of a 2009

Model Tata HGV Goods Carriage bearing Registration No.KL-25-

A-7490. The grievance of the petitioner is that his vehicle is

illegally detained by the 2nd respondent from 22.12.2009 for

alleged illegal transportation of river sand.

2. It is the case of the petitioner that the sand was covered

by valid pass Exhibit P2 issued by the 3rd respondent Panchayath.

Seeking for release of the vehicle, the petitioner has approached

this Court.

It is pointed out that the petitioner has already moved the

1st respondent in the matter seeking interim custody of the

vehicle. If the petitioner has already filed such an application,

the 1st respondent will consider the prayer for interim custody of

the vehicle within a period of one week from the date of receipt

of a copy of this judgment. The proceedings under the Kerala

Protection of River Banks and Regulation of Removal of Sand Act

2001 will be finalised within a period of two months, after hearing

the petitioner.

This writ petition is disposed of as above.
