2 12-07-2011 Counsel for the petitioner is permitted to add the
complainant as opposite party no. 2.
The petitioner looks after the property of Savitri Devi
who is the step sister of one Radha Singh. There is a Title Suit
pending between two which is 607 of 2004.
Learned counsel for the petitioner submits that because
the petitioner is working for Savitri Devi, the Complainant Radha
Singh has involved him in a number of cases. It is further
submitted that the allegations in the complaint petition would
indicate the improbability and falsity of the case in question.
Issue notice to opposite party no. 2 by ordinary
process. A copy of notice should also be filed in the office of this
Court to be served on the counsel appearing on behalf of opposite
party no. 2 in Complaint Case No. 1614(c) of 2005 through the
Court of the Judicial Magistrate, 1st Class, Patna.
Requisites etc. for which must be filed within a period
of one week failing which this application shall stand dismissed
without further reference to a Bench.
List this case on appearance of opposite party no. 2.
In the mean time, further proceedings in the aforesaid
case shall remain stayed subject to the fact that charges have not
yet been framed in this case.
