of counsel for the petitioner.

It is stated that the petitioner does not

want to pres this application in view of the fact

that Sessions Trial No. 424 of 2007 pending in the

court of F.T.C. 1, Nawada is at the last stage

wherein evidence has also been completed.

In view of aforementioned facts, counsel

for the petitioner seeks permission to withdraw

this application.

This application is accordingly dismissed

as withdrawn.
