3 27.06.2011 This Court had passed in the writ petition an order in respect

of release of certain commodities by the Customs Department. The

Department, being aggrieved, preferred a Letters Patent Appeal in which

the order of this Court was modified. Even that modified order was not

complied with by the Customs Authorities and, as such, petitioner filed a

contempt application being MJC No 3603 of 2009 which was disposed of

on 21.09.2010 with certain directions. Now when this present contempt

application, which was filed long before, was taken up, petitioner seeks

enforcement of the order of this Court.

In my view, the order of this Court having been modified by

the Letters Patent Appeal, the remedy of the petitioner is before the

Division Bench. Liberty is granted to the petitioner to move the Division

Bench for any clarification or any other relief that he seeks.

This application is disposed of.
