IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 17505 of 2010(K) 1. SAFIYAMMA.,W/O.SAKKEER,KUNNAPPALLY HOUSE ... Petitioner Vs 1. STATE OF KERALA, RERPESENTED BY ... Respondent 2. THE DIRECTOR OF SOCIAL WELFARE, 3. THE UNION OF INDIA, REPRESENTED BY THE 4. THE DISTRICT SOCIAL WELFARE OFFICER, 5. THE CHILD DEVELOPMENT PROJECT OFFICER, For Petitioner :SRI.P.VIJAYA BHANU For Respondent : No Appearance The Hon'ble MR. Justice ANTONY DOMINIC Dated :14/06/2010 O R D E R ANTONY DOMINIC, J. ------------------------- W.P.(C.) No.17505 of 2010 (K) --------------------------------- Dated, this the 14th day of June, 2010 J U D G M E N T
The petitioner’s main complaint is that in the matter of
selection to the post of Anganwadi Workers, she has been wrongly
denied marks, which are provided for in Ext.P4. To substantiate this
contention, referring to Ext.P5, the learned counsel contends that
although to the inmates of SWD (Social Welfare Department) Hostel,
marks are provided, no mark has been awarded to the petitioner. It
is on this basis, challenge has been raised.
2. However, the learned Government Pleader referring to
Ext.P4 Government Order providing the guidelines states that marks
are to be awarded to the inmates of hostels, which are under the
control of the SWD. Reference in this connection is made to Clause
12 of Ext.P4. It is stated that Ext.P1 is the certificate produced by
the petitioner and that the said certificate has been issued by the
Board of Control of Orphanages and Other Charitable Homes, which
is not an establishment under the control of SWD.

3. Column 12 of Ext.P4 provides that inmates of hostels
under the control of SWD are eligible for marks as provided therein.
Admittedly, Ext.P1 certificate produced, at best, is issued by an
organisation recognised by the SWD, and it is not a hostel under the
control of the SWD.
If so, as rightly contended by the learned Government Pleader,
the petitioner can have no grievance.
The writ petition fails and is accordingly dismissed.
