Anticipatory bail application filed by petitioners, Saket
Agrawal and Arjun Soren @ Arjun Murmu is moved by Sri Rakesh Kumar
Sinha learned counsel for the petitioners and opposed by Sri P.K. Appu
learned Additional P.P.
It appears from Annexure-2 that petitioner no. 1 Saket
Agrawal is licensee for excavating quartzite (Minor Mineral) and his
license was valid till 26.03.2011. It is stated that petitioner no. 2 is the
munshi of petitioner no. 1.
Considering the aforesaid facts and circumstance, I allow this
application and direct petitioners, above named, to surrender in the court
below on or before 18th of April 2011. If petitioners surrender by that time,
the learned Court below is directed to enlarge them on bail on furnishing
bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like
amount each to the satisfaction of learned Chief Judicial Magistrate,
Jamshedpur in connection with Potka P.S. Case No. 81 of 2010
corresponding to G.R. No. 3015 of 2010 subject to the condition laid down
under Section 438 (2) of the Cr.P.C.
