Heard learned counsel for the petitioners as well as
learned counsel for the state.
Above-said Misc. Cases arise out of Sasaram
(Tilauthu) P.S. Case No. 583/10 registered u/S 307 & other
minor sections of the of the Indian Penal Code as well as 27 of
the Arms Act and accordingly, both the aforesaid Cr. Misc.
Cases are being disposed of by this common order.
Admittedly, there is land dispute between the parties
and petitioners are not assailants. No doubt, petitioner in Cr.
Misc. No. 32052 of 2010 is said to be order giver but admittedly,
he is in jail custody since 23.07.2010.
Considering the aforesaid facts and circumstances as
well as submissions of the parties, petitioners, namely, Salamat
Ansari and Islam Ansari are directed to be released on bail on
furnishing bail bond of Rs 10,000/- (ten thousand) each with two
sureties of the like amount each in connection with Sasaram
(Tilauthu) P.S. Case No. 583 of 2010 to the satisfaction of Chief
Judicial Magistrate, Sasaram.
