Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that the applicant is in jail since
18.7.2005 and the trial is pending. He also contended that there was some
dispute in between the children and the applicant was falsely implicated in the
present case.
Learned A.G.A submitted that in fact there was some quarrel in between the
children of the parties and the applicant started abusing the children. When
the objection was raised by the complainant then he assaulted with knife
causing injuries i.e. three incised injuries on the chest of the victim. Since
the specific role has been assigned to the applicant, hence he is not entitled for
bail.
Considering the fact and circumstances of the case and the role of the
applicant at this stage it is not a fit case for bail.
However, the trial court is expected to conclude the trial as expeditiously as
possible, preferably within a period of six months from the date of production
of a certified copy of this order.
With the above observation this application is rejected.
