Heard learned counsel for the appellant and the learned A.G.A. and perused
the the record.

It is contended by the learned counsel for the appellant that according to the
prosecution version 7 kg ganja has been recovered from the possession of the
appellant, there is no compliance of the mandatory provisions of N.D.P.S.
Act. Sentence of 4 years have been awarded.

Let the appellant Sameer convicted in S.T. no. 2 of 2009 under Section 8/20
N.D.P.S. Act P.S. Sector 20 Noida District Gautam Budh Nagar be released
on bail on his furnishing a personal bond and two sureties each in the like
amount to the satisfaction of the Court concerned.

The realization of fine shall remain stayed during the pendency of the appeal.
