Heard learned counsel for the application and learned A.G.A. and perused the
record.
It is said that on account of transfer of the case from Special Judge , Faizabad
(Gangsters Act) to the court of Special Judge, Gangsters, Gonda on 25.10.08,
he could not get any information on account of which he could not appear
before the transferee court. It is said it was not deliberate. He has said to be on
bail which has not been cancelled, it is claimed.
In view of the above this petition is finally disposed of with the direction that
the order regarding issuance of non bailable warrant shall be kept in abeyance
for two weeks and within this period petitioner shall appear before the court
below.
This petition is finally disposed of.
