Heard learned counsel for the petitioner and learned Standing Counsel.
Notices have been accepted by learned Standing Counsel on behalf of the
respondents.
Learned counsel for the respondents prays for and is allowed two weeks time
to file counter affidavit. Rejoinder affidavit be filed within two weeks
thereafter.
List after expiry of the aforesaid period.
The petitioner has placed an interim order passed by this Court in Writ
Petition No.33151 of 2010 on 3.6.2010 and sought similar order.
According to the learned counsel for the petitioner, the petitioner is also
similarly circumstanced and may be allowed benefit of the above said order
passed in Writ Petition No.33151 of 2010.
As an interim measure, without prejudice to the right and contention of the
parties, since the last date for submitting the forms is 8th June, 2010 and the
Government itself is taking vacillating stand and appears to be not sure about
the fixation of age limit, which transpires from the conduct of the respondent
in between 17th May to 1st June, 2010, it is provided that the applications
invited pursuant to the advertisement dated 17.5.2010 be considered
provisionally and the candidates who are above 30 years and upto 35 years,
their applications be not rejected on the ground that they crossed the upper
age limit of 30 years fixed vide Government Order dated 1.6.2010.
The appropriate authority may consider the application of the petitioner
allowing her age relaxation and may consider her application to seek
condonation of delay.
