ORAL
ORDER

Rule.

Mr. H.L. Jani, learned Additional Public Prosecutor waives service of
rule on behalf of the respondent-State.

Considering
the rival submissions, I am of the considered view that prayer as set
out in paragraph 5(A) is required to be granted.

Condition
No.5 imposed by order dated 21.02.2008 shall be kept in abeyance for
a further period of six months commencing from today, i.e. 15th
February 2011.

Learned
advocate Mr. Nayak has produced the passports of the applicants
before this court and explained the situation as to why it could not
be produced before the lower court. Non-production of the passport
before the lower court is condoned and the passports are returned to
learned Advocate for the applicants. However, after expiry of the
period of six months granted by this order, the applicants shall
deposit their passports before the lower court without fail.

This
application is allowed accordingly.

Rule
is made absolute accordingly.

Direct
Service is permitted.
