Heard learned counsel for the applicant, learned A.G.A. for the
State and perused the record.
Learned counsel for the applicant contended that showing three
cases against applicant No.1 and two cases against applicant No.2
in the Gang Chart applicant s have been challaned under the
Gangster Act and in those cases applicants have already been
released on bail. Co-accused Bhimsen, Krishna Gopal, Hari Om
have already released on bail. However, in the present case,
applicant No.1 is in jail since 12.1.2010 and applicant No.2 is in
jail since 30.12.2009
Considering all the facts and circumstances of the case and without
expressing any opinion on merits of the case, I find it a fit case for
bail.
Let the applicants namely, Sanjai Diwakar and Ravi Diwakar
be released on bail in Case Crime No. 11 of 2010, under section
2/3 Gangster Act, P.S. Shahganj, District Agra on their furnishing
a personal bond with two sureties each in the like amount to the
satisfaction of the Court concerned.
