Heard learned counsel for the petitioner and learned Standing Counsel for the
State-respondents.
Petitioner seeks disposal of his application for recall of the order dated 17th
March, 2008 being Case No. 59 of 2008 passed in Revision No.
25/32/42/2004, which is stated to be pending before the Collector, Jaunpur.
In the facts and circumstances of the case, without entering into the merits of
the application so filed by the petitioner and without expressing any opinion
on merits thereto, this writ petition is disposed of by requiring the Collector,
Jaunpur to consider and decide the application of the petitioner being Case
No. 59 of 2008 for recall of the order dated 17th march, 2008, strictly in
accordance with law, after affording opportunity of hearing to the parties
concerned, preferably within two months from the date a certified copy of this
order is filed before him.
