parties.
Petitioner along with two other
accused persons namely Dara Chaudhary and
one un-known person committed gang rape upon
the informant is denied on the ground that
none of the named F.I.R witnesses including
informant’s daughter and one Ramayan Ram has
supported taking place of the occurrence.
Witness No. 2 is daughter of the informant
but was never produced before the police
while attempt was made to get her examine
and witness No. 1 is denying taking place of
any incident.
Taking that into consideration, in
the event of arrest or surrender within one
month from the date of communication of this
order, the above named petitioners, shall be
released on bail on furnishing bail bond of
Rs. 10, 000/- (ten thousand) each with two
sureties of the like amount each to the

satisfaction of Assistnat Chief Judicial
Magistrate Bagaha West Champaran in
Valiminagar P.S. Case No. 10 of 2010 subject
to the condition laid down under section
438(2) Cr. P.C.
