02 14.02.2011 Heard learned counsel for the petitioners as well
as learned Public Prosecutor for the State.
Petitioners seek their bail in connection with
Akorhigola P.S. Case No. 32 of 2010 registered under Section
395 of the Indian Penal Code.
Petitioners are not named in the First
Information Report and it appears from perusal of the
impugned order that in course of investigation, the name of
petitioners came in this case in the statements of witnesses
Dhanjee Pasi and Baudh Pasi vide paragraphs no. 69 and 70
respectively and subsequently, one co-accused Ashok Yadav
also named the petitioners in his confessional statement.
Learned counsel for the petitioners points out
that the aforesaid witnesses, namely, Dhanjee Pasi and Baudh
Pasi are none else but sons of informant and so far as co-
accused Ashok Yadav is concerned, he has already been
granted privilege of bail by another Bench of this Court vide
order dated 08.11.2010 passed in Cr. Misc. No. 37249 of 2010.
Considering the aforesaid facts and
circumstances as well as submissions of the parties, above
named petitioners are directed to be released on bail on
furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two
sureties of the like amount each to the satisfaction of Chief
Judicial Magistrate, Rohtas at Sasaram in connection with
above Stated Akorhigola P.S. Case No. 32 of 2010.
